AI CRISTIANI È… PERMESSO !
È incredibile ciò che la nostra magistratura è capace di fare quando tra le parti in causa c’è gente politica di un colore diverso dal rosso o quando ci si imbatte in questioni religiose, curiosamente ci si batte nel parlamento per dar vita ad una legge che tuteli ancora di più le persone, nel caso specifico parliamo di soggetti dello stesso sesso che dei disabili, e poi si assiste all’ennesima sentenza incomprensibile e discriminatoria che va esattamente nella direzione opposta del ddl Zan e del rispetto di miliardi di cristiani nel mondo e della chiesa cristiana intesa come Stato Vaticano. E quindi… sulla base dei contenuti di questa sentenza “straordinaria”… chiunque, nessuno escluso, può dire ciò quel che vuole e offendere, come gli pare, la religione cristiana ? Siamo su una direzione opposta al rispetto delle convinzioni religiose e da ciò ne viene che io potrei offendere i fedeli di altra confessione, per esempio gli islamici, o insultare rom e neri senza dovermi preoccupare per le conseguenze penali ? O attenzione… mi sorge un ragionevole dubbio: ma le offese e il razzismo discriminatorio vanno benissimo solo quando si tratta dei cristiani e della religione di Cristo ? Stante la sentenza di assoluzione, dopo la ovvia condanna di primo grado, mi chiedo se le identiche offese volgari le rivolgessi ad una copia di gay o di rom o di neri, che circolano liberamente per le via pubblica… cosa mi accadrebbe penalmente dopo ? Presumo che sulla base della nuova sentenza, cui ne prendiamo atto con “viva soddisfazione”… l’offesa a loro sarebbe legittima farla o invece sarei un reo perché quelli magari non sono cristiani? È certamente un “dubbio amletico”… perché a questo punto non comprendo il significato di una proposta di legge, ddl Zan, che ha provocato tanto rumore e alimentato polemiche, che rapportandola all’assoluzione di un signore, offensivo e ripugnante e come sempre arrogante e presuntuoso, che ha la pessima abitudine di offendere la cristianità dove ci si trova una logica e razionalità ? Sono inorridito per questa sentenza che la magistratura dovrà spiegare bene agli italiani di fede cristiana del perché. Ora voglio proprio vedere che fine faranno tutte le denunce presentate per ipotesi di offese dai fedeli mussulmani contro “gli infedeli” o per loro… le offese non sono consentite ? Un quattro novembre davvero esaltante, la vittoria di chi ora può denigrare la chiesa e il mondo cristiano… di chi è sempre fedele all’idea che “dar addosso al cristiano si può sempre” e non è più un reato ! Sarebbe politicamente corretto dire che le sentenze vanno accettate sempre… sarà, ma io questa non l’accetto proprio… anzi, sono scorretto e dico che la rifiuto e la rinnego come sentenza di un tribunale civile di un n paese democratico. La I Corte d’Appello penale di Milano ha assolto, ribaltando la condanna di primo grado, il fotografo Oliviero Toscani dall’accusa di vilipendio della religione cattolica, per la quale il Tribunale gli aveva invece inflitto una multa di 4 mila euro. Nella trasmissione radiofonica «La Zanzara» del 2 maggio 2014 su Radio 24, interpellato dai conduttori Giuseppe Cruciani e David Parenzo sulla pedofilia nella Chiesa, Toscani aveva immaginato di essere un marziano atterrato in una chiesa e, in questa chiave, si era lanciato in paradossi sull’iconografia religiosa: «Vedi uno inchiodato alla croce, un altare con bambini nudi che volano… Poi quell’altro sanguinante… la Chiesa sembra un club sadomaso». E aveva poi lamentato che «Papa Bergoglio dice cose banali», e che «fanno santo Wojtyla che era contro il preservativo in Africa, un assassino».

Cattivo gusto, forse, ma anche vilipendio per il pm Stefano Civardi che aveva istruito il processo, nel quale le associazioni querelanti, «Giuristi per la vita» e «Pro vita», avevano chiesto 100 mila euro l’una di danni, ottenendo 500 euro dal giudice Ambrogio Moccia. «Io sono credente, a modo mio. Sono religiosamente laico, ma soprattutto sono per la libertà di pensiero, di critica. Mi offende — aveva protestato Toscani all’epoca — ritrovarmi condannato per vilipendio della religione e dei Papi, quando ho fatto solo critiche estetiche o di scelte politiche, non certo in materia religiosa. La verità è che noi in Italia non siamo ancora un paese laico, anzi siamo tornati indietro di decenni. Ma non mi arrendo: farò appello con il mio avvocato Caterina Malavenda». E ora l’Appello (motivazione fra 60 giorni) l’ha assolto, aderendo peraltro alla non scontata richiesta di assoluzione formulata anche dal sostituto procuratore generale Cuno Tarfusser.

C’est incroyable ce que notre justice est capable de faire quand parmi les partis impliqués il y a des gens politiques d’une autre couleur que le rouge ou quand on tombe sur des questions religieuses, curieusement on se bat au parlement pour donner vie à une loi qui protège encore plus les gens, dans ce cas précis, nous parlons de sujets du même sexe que les personnes handicapées, et puis nous assistons à une nouvelle condamnation incompréhensible et discriminatoire qui va exactement à l’encontre du projet de loi Zan et du respect de milliards de chrétiens dans le monde et de l’Église chrétienne comprise comme l’État du Vatican. Et donc… sur la base du contenu de cette phrase “extraordinaire”… quelqu’un, sans exception, peut-il dire ce qu’il veut et offenser, à sa guise, la religion chrétienne ? Sommes-nous dans le sens inverse du respect des convictions religieuses et il s’ensuit que je pourrais offenser les fidèles d’autres confessions, par exemple les musulmans, ou insulter les Roms et les Noirs sans avoir à me soucier des conséquences pénales ? O attention… un doute raisonnable surgit : mais les délits et le racisme discriminatoire ne sont acceptables que lorsqu’il s’agit des chrétiens et de la religion du Christ ? Compte tenu de la peine d’acquittement, après la peine évidente du premier degré, je me demande si les délits vulgaires identiques que j’ai adressés à une copie de gays ou de Roms ou de noirs, qui circulent librement sur la voie publique… que m’arriverait-il pénalement après ? Je suppose que sur la base de la nouvelle peine, que nous reconnaissons avec “une grande satisfaction”… serait-il légitime de les offenser ou serais-je un délinquant parce qu’ils ne sont peut-être pas chrétiens ? Il s’agit certainement d’un « doute hamletique »… car à ce stade je ne comprends pas le sens d’un projet de loi, la loi Zan, qui a fait tant de bruit et alimenté la polémique, qu’en le comparant à l’acquittement d’un gentleman, injurieux et repoussant et comment toujours arrogant et présomptueux, qui a la mauvaise habitude d’offenser le christianisme là où il y a une logique et une rationalité ? Je suis horrifié par cette phrase que la justice devra bien expliquer aux Italiens de foi chrétienne pourquoi. Maintenant, je veux vraiment voir ce qu’il adviendra de toutes les plaintes présentées pour des délits présumés par les fidèles musulmans contre “les infidèles” ou pour eux… les délits ne sont-ils pas autorisés ? Un 4 novembre vraiment grisant, la victoire de ceux qui peuvent désormais dénigrer l’église et le monde chrétien… de ceux qui sont toujours fidèles à l’idée que “on peut toujours porter un chrétien” et ce n’est plus un crime ! Il serait politiquement correct de dire qu’il faut toujours accepter les peines… ça le sera, mais je ne l’accepte pas du tout… au contraire, je me trompe et je dis que je le rejette et je le nie comme une sentence d’un tribunal civil d’un pays démocratique.
