GREEN PASS O NON… PASSI !
Il governo ha deciso sull’utilità della certificazione verde e non ha inteso tener conto di situazioni particolari o eventualmente tollerabili, niente di tutto questo… quindi il ” Green Pass” è obbligatorio, ci piaccia o non ci piaccia, legale o illegale, ora bisogna averlo obbligatoriamente e… va bene, mettiamoci l’anima in pace e non se ne parli più ! Solo che mi sorge un dubbio amletico e conflittuale e cioè, chi è legittimato a chiedermelo ? E già, il punto di domanda è proprio questo, perché se il certificato verde diventa una sorta di “documento personale”, legato alla identità del vaccinato, a richiesta può essere esibito solo ai pubblici ufficiali e certamente non ad un semplice cittadino commerciante o ad un vigilante dinanzi ad un centro commerciale o ad una banca. Com’è anche nelle strutture ricettive turistiche come il ristorante o cinema o parchi giochi, e allora i loro incaricati al controllo diventano pubblici ufficiali per decreto ? Non credo che questa concessione sia costituzionalmente compatibile in quanto vi sono due ostacoli, il primo è la legge sulla privacy e il secondo è quello relativo all’identità del pubblico ufficiale, problemi che non sono chiari e trasparenti come invece dovrebbero essere. Ed io, ho il diritto, poi esibito il mio Green Pass, di chiedere a mia volta di prendere visione della certificazione a chi mi controlla e del suo documento personale ? E poi, ho diritto a verificare tutte le sanificazioni quotidiane che avvengono in dette attività ? E chi mi garantisce che se sono esposte al pubblico in una bacheca tutte le attività svolte per la sanificazione sono veramente svolte quotidianamente e non vengono solo modificate le date ? Obiettivamente questa certificazione presenta tanti problemi e sicuramente ne sentiremo di belle e di curiose quando un ristoratore chiederà il pass per un primo o il panettiere per vendere un panino. Non ho problemi a richiederlo, ma come linea di principio teorico non funziona, perché qualcuno dubitando del mio codice potrebbe chiedermi il documento d’identità e a quel punto che si fa ? Ovvio che lo mando in vacanza a quel paese… però il problema si può presentare anche in senso fraudolento, infatti posso dare il mio cellulare, contente il codice, ad un parente o ad un amico ed ecco che così il “castello del Green Pass” incontrerebbe l’onda del mare che lo spazzerebbe via in un momento impietosamente, alimentando discussioni a non finire e magari anche liti. È da giorni che rifletto sulla questione e alla fine mi sono reso conto che per verificare un certificato verde sarà necessario legarlo ad un documento d’identità per la sua conferma e convalida. Il Consiglio dei ministri ha dato il via libera al nuovo decreto legge Covid. Il Cdm ha dato anche l’autorizzazione della fiducia sulla riforma della giustizia
“L’economia va bene, si sta riprendendo e l’Italia cresce a un ritmo anche superiore a quello di altri Paesi europei. La variante Delta è anche più minacciosa di altre varianti”, ha detto il premier, Mario Draghi, in conferenza stampa.
Gli italiani si vaccinino, devono proteggere se stessi e le loro famiglie, è l’appello di Draghi il quale ha chiarito che il green pass non è un arbitrio ma una condizione per non chiudere le attività produttive. “Ad oggi abbiamo inoculato 105 dosi ogni 100 abitanti, come la Germania, più di Francia e Usa”, ha detto ancora Mario Draghi
“L’estate è già serena e vogliamo che rimanga tale – ha spiegato il presidente del consiglio -.
Il Green pass è una misura con i quali i cittadini possono continuare a svolgere attività con la garanzia di ritrovarsi tra persone che non sono contagiose. E’ una misura che dà serenità, non che toglie serenità”
“Senza vaccinazione si deve chiudere tutto, di nuovo”, ha insistito il premier: “Appello a non vaccinarsi è un appello a morire”.
Draghi ha detto anche che c’è un “accordo pieno a risarcire le discoteche, ne abbiamo doscusso in consiglio dei ministri’
Rispondendo ad una domanda sul green pass per i luoghi di lavoro, Draghi ha risposto: “Sono due punti che suonano come una non risposta, ci stiamo pensando. E’ questione complessa e da discutere con i sindacati”.
“Abbiamo deciso in accordo con le regioni che il tasso di ospedalizzazione sia il ‘driver’ per il cambio dei colori nelle regioni”, ha detto il ministro della salute Roberto Speranza nel corso della conferenza stampa.
“Per tutto il governo – ha detto ancora Speranza – la scuola è una priorità assoluta e faremo ogni sforzo per consentire una riapertura in piena sicurezza è in presenza. Ma non vorrei che passi un messaggio che negli insegnanti c’è sfiducia perché l’85% si e’ vaccinato c’è un 15% da recuperare e credo che dobbiamo valutare tutti gli strumenti potenziali per recuperare questo 15%”.
“Una volta individuato il green pass come strumento che garantisce le attività, credo che sulle discoteche una riflessione mi auguro si possa ancora fare”. Lo auspica il sottosegretario alla Salute Andrea Costa alla Fiera di Genova in occasione di una nuova open night per le vaccinazioni organizzata da Regione Liguria. “Parliamo di un settore economico del nostro Paese, in un momento in cui condividiamo il green pass come strumento di garanzia, credo che ci sia il margine per un’ulteriore riflessione sulla riapertura delle discoteche”, aggiunge.
LE MISURE DEL DECRETO
Lo stato d’emergenza per il Covid dovrebbe essere prorogato fino al 31 dicembre 2021. E’ quanto emerge dalla cabina di regia a Palazzo Chigi, confermando le ipotesi della vigilia.
Il Green pass dal 6 agosto servirà per accedere ai tavoli al chiuso di bar e ristoranti.
Il certificato verde – spiegano fonti governative – non sarà invece necessario per consumare al bancone, anche se al chiuso.
Terapie intensive al 20% e al 30% per le aree mediche per diventare arancioni e rispettivamente al 30 e al 40% per entrare in zona rossa. Sono questi i parametri per il cambio di colore delle regioni messi a punto in Cabina di regia
Le discoteche resteranno chiuse. Lo ha deciso la cabina di regia che si è riunita a Palazzo Chigi. Nessun accesso, dunque, neanche per i possessori di Green pass. La Lega in cabina di regia avrebbe insistito per l’apertura, con nuove regole.
Arriva anche l’obbligo di Green pass per cinema e teatri, ma aumenta il numero di spettatori ammessi ad assistervi, sia al chiuso che all’aperto. E’ quanto si apprende da fonti di governo sulle misure del nuovo decreto legge Covid. In zona gialla si entrerà a cinema e teatro con Green pass, mascherina e distanziamento, ma gli spettatori potranno salire all’aperto dagli attuali 1000 fino a un massimo di 2500 e al chiuso da 500 a 1000. Mentre in zona bianca, dove ora sono fissati limiti di capienza, viene fissato un tetto all’aperto di 5000 persone e al chiuso di 2500 persone.

Le gouvernement s’est prononcé sur l’utilité de la certification verte et n’a pas eu l’intention de prendre en compte des situations particulières ou éventuellement tolérables, rien de tout cela… maintenant tu dois l’avoir et… d’accord, mettons notre âme en paix et n’en parlons plus ! Seulement qu’un doute hamlétique et conflictuel surgit et c’est-à-dire, qui a le droit de me le demander ? Et oui, le point d’interrogation est justement celui-ci, car si le certificat vert devient une sorte de « document personnel », lié à l’identité de la personne vaccinée, sur demande il ne peut être montré qu’à des agents publics et certainement pas à un simple commerçant citoyen ou à un superviseur devant un centre commercial ou une banque. Comment se passe-t-il aussi dans les structures d’hébergement touristique comme les restaurants ou les cinémas ou les aires de jeux, et alors leurs agents de contrôle deviennent des agents publics par décret ? Je ne pense pas que cette concession soit constitutionnellement compatible car il y a deux obstacles, le premier est la loi sur la vie privée et le second est celui relatif à l’identité de l’agent public, des problèmes qui ne sont pas aussi clairs et transparents qu’ils devraient l’être. Et moi, j’ai le droit, alors exhibé mon Pass Vert, de demander à mon tour d’inspecter l’attestation à celui qui me contrôle et son document personnel ? Et puis, ai-je le droit de vérifier toutes les désinfections quotidiennes qui ont lieu dans ces activités ? Et qui peut me garantir que si elles sont affichées au public sur un babillard, toutes les activités réalisées pour l’assainissement sont réellement réalisées au quotidien et pas seulement les dates sont modifiées ? Objectivement, cette certification présente de nombreux problèmes et on en entendra sûrement parler de beaux et curieux lorsqu’un restaurateur demandera le pass pour une entrée ou le boulanger pour vendre un sandwich. Je n’ai aucun problème à le demander, mais comme principe théorique cela ne fonctionne pas, car quelqu’un qui doute de mon code pourrait me demander une pièce d’identité et à ce moment-là que faites-vous ? Evidemment je l’envoie en vacances dans ce pays… mais le problème peut aussi être présenté dans un sens frauduleux, en fait je peux donner mon téléphone portable, avec le code, à un parent ou à un ami et voici le “château du Green Pass » rencontrerait la vague de la mer qui l’emporterait dans un moment impitoyable, alimentant des discussions sans fin et peut-être même des querelles. J’y réfléchis depuis des jours et au final je me suis rendu compte que pour vérifier un certificat vert il faudra le lier à une pièce d’identité pour sa confirmation et sa validation. Les Italiens se font vacciner, ils doivent se protéger et protéger leurs familles, c’est l’appel de Draghi qui a précisé que le pass vert n’est pas un arbitrage mais une condition pour ne pas fermer les activités de production. « A ce jour, nous avons inoculé 105 doses pour 100 habitants, comme l’Allemagne, plus que la France et les USA », a encore rappelé Mario Draghi.
“L’été est déjà paisible et nous voulons qu’il le reste – a expliqué le Premier ministre -.
Le laissez-passer vert est une mesure avec laquelle les citoyens peuvent continuer à exercer des activités avec la garantie de se retrouver parmi des personnes non contagieuses. C’est une mesure qui donne de la sérénité, pas qui enlève la sérénité”
“Sans vaccination, tout doit être refermé”, a insisté le Premier ministre : “Un appel à ne pas se faire vacciner est un appel à mourir”.
Draghi a également déclaré qu’il existe un “accord complet pour indemniser les discothèques, nous en avons entendu parler en conseil des ministres”
Répondant à une question sur le laissez-passer vert pour les lieux de travail, Draghi a répondu : “Ce sont deux points qui sonnent comme une non-réponse, nous y réfléchissons. C’est une question complexe à discuter avec les syndicats”.
« Nous avons décidé en accord avec les régions que le taux d’hospitalisation est le « moteur » du changement de couleur dans les régions », a déclaré le ministre de la Santé, Roberto Speranza, lors de la conférence de presse.
“Pour l’ensemble du gouvernement – a déclaré Speranza – l’école est une priorité absolue et nous mettrons tout en œuvre pour permettre une réouverture en toute sécurité est en présence. % ont été vaccinés il y a un 15% à récupérer et je crois que nous devons évaluer tous les outils potentiels pour récupérer ces 15%”.

LES MESURES DU DECRET
L’état d’urgence du Covid devrait être prolongé jusqu’au 31 décembre 2021. C’est ce qui ressort de la salle de contrôle du Palazzo Chigi, confirmant les hypothèses de la veille.
Le pass Vert à partir du 6 août sera utilisé pour accéder aux tables intérieures des bars et restaurants.
Le certificat vert – expliquent des sources gouvernementales – ne sera pas nécessaire pour consommer au comptoir, même à l’intérieur.

C’est ce qu’on apprend de sources gouvernementales sur les mesures du nouveau décret-loi Covid. Dans la zone jaune vous entrerez dans le cinéma et le théâtre avec pass vert, masque et espacement, mais les spectateurs pourront sortir à l’extérieur des 1000 actuels jusqu’à un maximum de 2500 et à l’intérieur de 500 à 1000. Tandis que dans la zone blanche, là où les limites de capacité sont désormais établies, un toit extérieur de 5 000 personnes et un toit intérieur de 2 500 personnes sont mis en place.
